1. Agreement to Terms

By accessing or using Vinders ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Vinders is a location-based service that allows users to discover, share, and manage points of interest (POIs). The Service includes features for creating, searching, and interacting with location data on interactive maps.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You may create an account by:

  • Registering with an email address and password
  • Using a social login provider (Google, Facebook, Apple, Instagram, TikTok, Discord)

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we deem inappropriate or harmful to the Service or other users.

4. User Content

4.1 Content Ownership

You retain ownership of any content you submit, post, or display on the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service.

4.2 Content Guidelines

You agree not to submit User Content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights
  • Contains harmful, threatening, or abusive material
  • Contains false or misleading information
  • Contains spam or unsolicited advertising
  • Contains malicious code or viruses

4.3 Content Moderation

We reserve the right to remove or modify any User Content that violates these Terms or that we deem inappropriate, without prior notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems (bots, scrapers) without permission
  • Collect or store personal data of other users without consent
  • Impersonate any person or entity
  • Harass, abuse, or harm other users

6. Intellectual Property

The Service, including its design, functionality, and content (excluding User Content), is owned by Vinders and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

7. Third-Party Services

The Service may contain links to third-party websites or integrate with third-party services (such as social login providers and map providers). We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9.2 Location Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of location data or POI information. Users should verify information independently before relying on it.

9.3 Limitation of Liability

To the maximum extent permitted by law, Vinders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Vinders and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
